Terms of service
Introduction
These Terms of Service govern the use of the Shop Around website, mobile application, and related services. By accessing or using the Shop Around platform, you agree to be bound by these Terms of Service. If you do not agree with these terms, you must not use the platform.
Shop Around provides a technology platform that enables customers to order products from participating supermarkets, greengrocers, and other retailers and have those items collected and delivered in a single combined delivery.
Platform Role
Shop Around operates as an online marketplace and delivery coordination service connecting customers with independent retailers. Shop Around does not manufacture, prepare, supply, or sell the products available on the platform. All products are supplied directly by participating retailers.
Retailers are solely responsible for product descriptions, pricing, product quality, food safety compliance, packaging, and preparation of orders. Shop Around’s role is limited to facilitating the transaction between the customer and the retailer and arranging delivery of the order.
Customer Eligibility
By using the platform, customers confirm that they are at least 18 years of age and capable of entering into legally binding agreements. Customers agree to provide accurate information when placing orders, including delivery details and payment information.
Customers are responsible for ensuring that the delivery address provided is correct and accessible during the delivery window selected at checkout.
Orders and Acceptance
Orders placed through the Shop Around platform are subject to acceptance by the participating retailer. A retailer may reject or cancel an order if items are unavailable, if there are issues with stock, or if the order cannot reasonably be fulfilled.
Shop Around reserves the right to cancel or refuse orders where there are reasonable grounds to suspect fraudulent activity, payment issues, or misuse of the platform.
Pricing and Payment
Prices displayed on the platform are set by the participating retailers. Delivery fees, service charges, or other fees may be applied to orders and will be clearly displayed at checkout.
Payment must be made at the time of placing the order using an accepted payment method available on the platform. By submitting payment details, customers authorise Shop Around and its payment processing partners to charge the relevant payment method for the total order value.
Substitutions and Product Availability
Product availability is determined by the participating retailer. If an item is unavailable after an order has been placed, the retailer may substitute the item with a similar product where appropriate unless substitutions have been declined by the customer.
In some cases, unavailable items may be removed from the order and refunded.
Delivery Services
Shop Around arranges for delivery drivers to collect orders from participating retailers and deliver them to the customer. Delivery times are estimates only and may be affected by traffic conditions, weather, retailer preparation time, or other operational factors.
Delivery drivers are responsible only for transporting orders from the retailer to the customer and are not responsible for product quality, order accuracy, or processing returns or refunds.
Returns and Refunds
Returns and refunds are governed by the Shop Around Returns and Refunds Policy. Due to the nature of grocery and perishable goods, returns may not be possible once an order has been delivered.
Refund requests must be submitted through the Shop Around platform and may be reviewed in cooperation with the retailer that supplied the item.
Chargebacks and Payment Disputes
Customers agree to contact Shop Around through the platform before initiating a chargeback or payment dispute with their bank or payment provider.
Where a chargeback is initiated without first attempting to resolve the issue through Shop Around’s support process, Shop Around reserves the right to suspend or restrict access to the platform while the matter is investigated.
Service Availability
Shop Around aims to provide reliable service but does not guarantee uninterrupted access to the platform. The service may be temporarily unavailable due to maintenance, technical issues, updates, or circumstances beyond our control.
Shop Around reserves the right to modify, suspend, or discontinue any part of the service at any time.
Limitation of Liability
To the fullest extent permitted by law, Shop Around shall not be liable for any losses arising from products supplied by retailers, including issues relating to product quality, product safety, product suitability, or product availability.
Shop Around’s liability is limited to the services it provides, which include facilitating orders and arranging delivery between retailers and customers. Shop Around shall not be liable for indirect, incidental, or consequential losses resulting from the use of the platform.
Force Majeure
Shop Around shall not be held responsible for delays or failure to perform its obligations where such delays or failures result from events beyond reasonable control. These may include but are not limited to natural disasters, severe weather, transportation disruptions, government restrictions, technical failures, labour disputes, or other unforeseen events.
User Conduct
Users agree not to misuse the platform or engage in activities that may disrupt or interfere with the operation of the service. Prohibited activities include fraudulent orders, abuse of refund systems, unauthorised access to systems, or attempting to interfere with platform functionality.
Account Suspension and Termination
Shop Around reserves the right to suspend or terminate user accounts where there is evidence of fraudulent activity, repeated abuse of the platform, violation of these Terms of Service, or other misuse of the service.
Intellectual Property
All content on the Shop Around platform, including logos, designs, text, software, and branding, is the property of Shop Around or its licensors and is protected by intellectual property laws. Users may not reproduce, copy, or distribute platform content without prior written permission.
Dispute Resolution
If a dispute arises between a customer and Shop Around regarding the use of the platform, both parties agree to attempt to resolve the matter through reasonable communication and negotiation before pursuing formal legal action.
Changes to the Terms
Shop Around may update or modify these Terms of Service from time to time. Updated terms will be published on the platform. Continued use of the platform following any updates indicates acceptance of the revised terms.
Governing Law
These Terms of Service shall be governed by and interpreted in accordance with the laws of England and Wales.
